Qualifying for Adjustment of Status

Adjustment of Status is available in different situations.  To qualify for AOS, you must be: 1) a relative of a U.S. citizen who qualifies for a family based immediate preference category visa; or 2) the beneficiary of an approved employment visa; and 3) presently living in the United States; 4) without a criminal record; 5) not have engaged in unauthorized employment in most cases; and 6) not presently be in removal proceedings.

AOS applicants can also simultaneously apply for a U.S. work permit.  An additional benefit of the AOS route is that applicants are permitted to travel outside of the United States for the duration of the processing period by receiving approval for Advance Parole.
